Terms of service

These terms are the agreement between you and OV1 Enterprises LLC (“we”) for using TopoScorer. By signing in, you agree to them.

The service

TopoScorer estimates how many people, and which kinds, live within a drive of places you choose, from public data and your own settings. It is offered free during early access. We may change, add or remove features as it develops.

Estimates, not advice

Every figure in TopoScorer is an estimate. Census figures come from a survey and have margins of error, drive times are typical rather than exact, and the results depend on the settings and competitor ratings you choose. TopoScorer is a tool to help you compare places. It is not business, financial, legal or real-estate advice, and it doesn’t predict sales. You are responsible for your decisions, including where to open, lease or buy.

Your account

• Keep access to your sign-in method secure. You’re responsible for what happens in your account.
• You must be at least 16 and able to agree to these terms.
• One person per account. To work with others, share a project with them instead.

Your data

What you save (sites, competitors, views, project names) stays yours. You let us store and process it to run TopoScorer for you and the people you share it with, as described in the privacy policy.

Fair use

Please don’t:

• use TopoScorer to break the law or to harm anyone;
• try to get into other people’s accounts or projects, or around our usage limits;
• copy the service or its data in bulk with scripts or automated tools;
• overload, disrupt or probe the service for weaknesses without our written permission.

Limits and availability

Some actions, such as new drive-time areas and address lookups, have hourly or daily limits per person so the service stays affordable. We try to keep TopoScorer running but can’t promise it will always be available or error-free.

Payment

TopoScorer is free during early access. If we introduce paid options, we’ll tell you the prices and terms before you’re asked to pay, and you won’t be charged unless you choose one.

Ending your use

You can stop using TopoScorer at any time and ask us to delete your account (see the privacy policy). We may suspend or close an account that breaks these terms, and will tell you why when we can. If we ever shut TopoScorer down, we’ll give you at least 30 days’ notice to get a copy of your data.

No warranty and limited liability

TopoScorer is provided “as is”, without warranties of any kind, including accuracy, fitness for a particular purpose and availability. To the extent the law allows, OV1 Enterprises LLC isn’t liable for indirect or consequential losses, such as lost profits or a lease you signed, and our total liability to you is limited to the amount you paid us in the 12 months before the claim (which, during free early access, is zero).

Changes to these terms

We may update these terms. We’ll change the date at the top, and tell you by email before a change that matters takes effect. Using TopoScorer after that means you accept the new terms.
